NRG Radio In Trouble For Riding on Eliud Kipchoge’s Brand

Kenyans have been riding high on long-distance runner Eliud Kipchoge, who recently acquired the title of World’s First Man to run a marathon in less than two hours, in a special event dubbed INEOS 1:59 in Vienna, Austria. NRG radio took it a notch higher by soliciting for 1 million Instagram following so they could gift Kipchoge with a brand new BMWi8. They even went ahead to change their social media pages and online blogs to Kipchoge. Radio and KipchogeRadio@NRGRadioKenya.

But today, KTK Advocates representing Eliud Kipchoge slapped NRG Radio with a demand letter for breach of brand rights invasion of privacy, breach of copyright, breach of trademark rights, which can only be transferred with the client’s permission.

“We have been retained by Eliud Kipchoge our client to write to you that you issued, a press release indicating your said intention to appropriate our client’s name and images on your various radios. Your twitter handle, your Instagram page, and other related digital platforms.

“That without his permission, authority or license you changed the name of your station topline on your social media pages and online blogs to his and fraudulently informed your Instagram page followers that you will gift our client a car,” read part of the demand letter to NRG Manager.

According to the law firm, NRG actions violate the Communication Law of Kenya and attracts criminal liability. The letter now demands, NRG to expunge his name, image, and reference in all its platform, an apology for violation of his rights and a written response to the firm that they have complied with the above.
